Online Classifieds, Advertising & Job Search Services Terms and Conditions

For the avoidance of doubt, these Terms and Conditions are an integral part of the Member Terms and Conditions (“Member Conditions”) and the Website Terms And Conditions (“Website Conditions”), which should all be read as a whole.

In the event of any conflict, inconsistency or ambiguity between these Terms and Conditions, the Member Conditions and/or the Website Conditions, the following descending order of precedence will apply: (i) these Terms and Conditions, (ii) the Member Conditions, (iii) the Website Conditions.

1. Definitions
1.1 All defined terms in the Website Conditions and Member Conditions, apply to the terms and conditions below unless specifically defined.
   
2. Classifieds, Advertising & Job Search Services
2.1 The following provisions shall apply where the Services include classifieds and/or advertising services:
 
2.1.1 You shall only submit, upload or publish advertisements on the Site for properties, cars, items or services, which you own, which you are qualified to provide, or which you are authorised to sell or offer for sale; and
2.1.2 SPH has no control over the properties, cars, items or services advertised, including the quality, merchantability, fitness for purpose, safety and legality of the items and/or services advertised, or the ability of sellers to sell items or to provide services, the ability of buyers to pay for items or services, or the completion of any transaction.
2.2 The following provisions shall apply where the Services include job search and/or other employment-related services:
 
2.2.1 You shall only submit, upload or publish advertisements on the Site, which set out clear, objective and relevant hiring criteria, and which are in compliance with:
 
2.2.1.1 the Tripartite Guidelines on Non Discriminatory Job Advertisements (2006), as may be amended or replaced;
2.2.1.2 such other relevant guidelines or policies which may be issued by the Singapore Ministry of Manpower from time to time; and
2.2.1.3 all applicable law, including where applicable the Singapore Employment Act (Cap. 91).
2.3 SPH has no control over User Content published on the Site, including the truth, accuracy, reliability or completeness of advertisements, listings, resumes, employment terms or conditions or other information submitted, such as quality, location, size, tenure, model, parts, indication of origin, or other descriptions of the property, car, item, or service being offered, and such User Content should be used, accepted and relied upon only with care and discretion and at your own risk, and SPH shall not be responsible for any loss, damage or liability incurred by you arising from such use or reliance.
2.4 SPH does not endorse or recommend and has no control over any advertiser, item/service, offer, job, position, appointment or job seeker appearing on the Service and you agree and undertake to use your own judgment and discretion in responding to or accepting any offer made via the Service.
2.5 SPH is not responsible for, and has not control over, the actions or inactions of its Members other users of the Service, and third parties (collectively “Third Parties”), including:
 
2.5.1 the failure of any Third Party to deliver, provide or make payment for any item and/or service, sold or purchased through the Service; or
2.5.2 the misrepresentation, fraud, breach of contract, tortious or illegal acts or omissions of any Third Party.
  You hereby agree to irrevocably waive any claim or right of action that you may have against SPH under applicable law, in relation to any action or inactions of any Third Party.
